Cepec a régulièrement été mandaté pour effectuer des analyses de rémunération des fonctions juridiques dans certaines entreprises. Un besoin de juristes, sensiblement accru sur le marché de l’emploi, a eu des effets significatifs sur leurs niveaux de rémunération ces dernières années. Nous avons donc décidé de réaliser une comparaison spécifiquement dédiée à ces fonctions afin de fournir aux entreprises, aux administrations et aux associations intéressées une vue d'ensemble actuelle.

Nous avons identifié 13 fonctions distinctes dans les services juridiques, soit 11 de juristes et 2 de spécialistes non universitaires. Ces fonctions sont décrites en français, en allemand et en anglais. Les attributions des fonctions dépendent essentiellement de la taille de l’entreprise, de la position du service juridique dans la structure et de son organisation interne.

Nos études préliminaires nous ont permis de mettre en évidence un grand intérêt pour les axes d’analyse suivants :

• Une analyse des rémunérations actuelles distinguant Base Salary (salaire de base) et Total Compensation, c'est à dire y compris les bonus.
• Une analyse spécifique des parts fixes et variables des rémunérations.
• Une comparaison des salaires d’engagement des collaborateurs des services juridiques ayant intégré l'entreprise entre 2006 et 2008.

Si le nombre de participants le permet, les données seront également analysées par branche ou secteur d’activité. Les entreprises pourront ainsi mesurer les rémunérations des fonctions dans des environnements comparables, voire concurrents sur le marché du travail.

Les coûts pour les entreprises participantes dépendent du nombre de fonctions analysées. Le nombre de collaborateurs dans chaque fonction n’influence en revanche pas le prix de l’étude. Une entreprise peut au maximum avoir sept fonctions juridiques. Les deux fonctions possibles de spécialistes (sans formation universitaire) ne sont pas prises en compte pour la fixation du prix.

Les données seront récoltées jusqu’à la fin du mois de juin 2008 et les résultats de l’enquête seront présentés début août 2008.

La facture correspondant au nombre de fonctions analysées vous parviendra après livraison du résultat de l’enquête.

Cepec carried out on behalf of customers often specific salary comparisons for lawyers of there in-house legal department. Obviously the demand for such lawyers has increased in the last period of time – and the salary-expectations of applicants and lawyers already employed have increased as well. We decided therefore to realise a specific benchmarking for these functions to provide the interested companies with an up-to-date overview.

We have described 13 different functions, 11 for lawyers and 2 for administrative/clerical functions, which can be found in a legal department of a company normally, in German, French and English. These descriptions take into account the size of a company and the different structures of the legal services.

Our preliminary inquiries with some companies showed as result that there is a big interest to analyse the data under different aspects:

• A specific analysis of the current remuneration, distinguishing between base-salary and total compensation, i.e. including bonus-payments
• A specific analysis of the ratio of fixed and variable remuneration
• A specific analysis of the salaries to be paid to newly hired lawyers who joined the company in the years 2006 to 2008.

Under the condition that the number of participants is sufficient the results will be shown separately for the different business sectors in addition, in order to enable the participants to compare their salaries with the real competitors on the labor market.

The costs for the participating companies will be different according the number of different functions within the legal service, whereas the number of jobs per function has no impact. A company can have seven different legal functions at most; the number of clerical/administrative functions will not be taken into consideration to fix the price.

After having received your enrollment we will send to you by e-mail within 48 hours the excel-sheet to collect the data as well as the instruction how to use this sheet. This will enable you to collect and to transmit the data in an easy and fast way.

Data will be collected until end of June, 2008. The results will be at your disposal as from the beginning of August, 2008.

You will get the invoice together with the files containing the results.
